INDEMNITY.

WHEREAS at the request of Thos. Cook & Son, Ltd., the

Railway Administration under the provisions of Section 32 (1)

of the Railways Ordinance No. 21 of 1909, has entrusted to

Thos. Cook & Son, Ltd., a plot of land situated near No. 2

Railway Bridge on the Railway Reclamation at Hung Hom, to be

retained by Thos. Cook & Son, Ltd., during the pleasure of the

Railway Administration and to be used for the open storage of

22 railway cars.

NOW THEREFORE in consideration of the premises Thos. Cook

& Son, Ltd., hereby contract with the Railway Administration to

save harmless and keep indemnified the Railway Administration

and its officers and servants from all damages and costs in

respect of all accidents damages and injuries happening to any

person or property through the use of the said plot of land by

Thos. Cook & Son, Ltd., or by any person in their employment or

by any person either expressly or impliedly authorised by them

to use the said plot of land or by any person trespassing on the

said plot of land through Thos. Cook & Son, Ltd. 's negligence.

AND Thos. Cook & Son, Ltd., further undertake not to

transfer the custody of the said plot of land without the

previous consent in writing of the Railway Administration.
